1. Introduction

This Privacy Policy explains how the companies of The Gear Centre Group of Companies collect, use, disclose, and protect personal information in connection with the websites listed in Section 2 (each, a “Site”), and in connection with their business operations, including parts and service locations across Canada.

“The Gear Centre Group of Companies” is a collective name for a group of separate, independently incorporated operating companies related through common ownership; it is not itself a legal entity. When this Privacy Policy refers to “we”, “us”, or “our”, it means the company responsible for the Site you are visiting, as identified in Section 2. Each company is individually responsible for the personal information it collects.

We are committed to protecting your privacy and handling your personal information responsibly, in accordance with the federal Personal Information Protection and Electronic Documents Act (“PIPEDA”), Alberta’s Personal Information Protection Act (“PIPA”), Canada’s Anti-Spam Legislation (“CASL”), and, where applicable to residents of that province, Quebec’s Act respecting the protection of personal information in the private sector (“Quebec Privacy Act”).

By using a Site or otherwise providing personal information to us, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the Site or provide us with personal information.

2. Which Company Is Responsible for Your Personal Information

This Privacy Policy applies to the following websites. The company listed beside each website is the legal entity responsible for personal information collected through it:

“The Gear Centre” is a registered trade name of Edmonton Gear Centre Ltd; The Gear Centre Truck & Auto and The Gear Centre Off-Highway are two business divisions of that same legal entity.

The careers section of gearcentregroup.com (gearcentregroup.com/careers) is operated by R.W. Gibson Consulting Services Ltd., a related company that manages recruitment on behalf of the companies above. Personal information submitted through job applications is governed by the separate Careers Privacy Policy published at gearcentregroup.com/careers/privacy-policy.

The companies above may share personal information with one another, and with related companies under common ownership, for internal administrative, IT, security, and customer service purposes as described in Section 7 (“How We Share Your Personal Information”), but each company remains individually responsible for the personal information it collects.

3. What We Mean by “Personal Information”

In this Privacy Policy, “personal information” means information about an identifiable individual, such as your name, contact details, or purchase history. It does not include aggregated or de-identified information that cannot reasonably be used to identify you, or business contact information used solely to communicate with you in your professional capacity.

4. Personal Information We Collect

The personal information we collect depends on how you interact with us. This may include:

Information You Provide to Us

  • Contact information, such as your name, mailing address, email address, and telephone number, when you submit a contact, quote, or service request form, or call or visit one of our locations.
  • Information about your vehicle, equipment, or parts needs, such as make, model, year, VIN, or serial number, when requesting a quote, ordering a part, or booking service.
  • Account information, such as a username and password, if you create an account on a Site.
  • Communications you send us, including emails, live chat messages (where live chat is offered), and information provided through customer surveys or reviews.
  • Information you provide if you sign up for marketing communications, newsletters, or promotions.

Information We Collect Automatically

When you visit a Site, we and our service providers may automatically collect certain technical information through cookies and similar technologies, including:

  • Your IP address, browser type and version, device type, and operating system.
  • Pages viewed, links clicked, time spent on pages, and referring/exit pages.
  • General geographic location inferred from your IP address (e.g. city or region).

Information From Other Sources

We may occasionally receive personal information about you from other sources, such as a business referral partner, an equipment or vehicle manufacturer, or publicly available sources, and combine it with information we already hold, in accordance with applicable law.

Site-Specific Features

Certain features are offered only on some of our Sites:

  • Online store and payment information (shop.gearcentre.com only): if you make a purchase through our online store, we collect the information necessary to process and fulfill your order, such as billing and shipping address, order details, and email address for order confirmations. Payment card information is collected and processed directly by our third-party payment processor and is not stored on our own servers. We recommend reviewing the privacy policy of our payment processor, which is identified at checkout.
  • Live chat (gearcentre.com, hydrasteer.com, and patsdriveline.com only): these Sites offer a live chat feature provided by a third-party service (Olark). If you use live chat, Olark collects the content of your chat messages, any offline messages you leave, your IP address, and related visitor information (such as browser and device details and the pages you viewed). Chat transcripts are stored by Olark on servers located in the United States. You are not required to use live chat to contact us; you may also reach us by phone or email.

5. How We Use Your Personal Information

We collect, use, and disclose your personal information only for purposes that a reasonable person would consider appropriate in the circumstances, including to:

  • Respond to your inquiries, quote requests, and service or repair bookings;
  • Process orders, payments, warranty claims, and returns;
  • Communicate with you about your order, appointment, account, or our services;
  • Provide customer support and respond to feedback or complaints;
  • Send you marketing, promotional, or product information, where you have consented to receive it, in compliance with CASL;
  • Improve and personalize our Sites and our products and services;
  • Maintain the security and integrity of our Sites and our systems, including fraud prevention;
  • Comply with legal, regulatory, tax, and accounting obligations; and
  • Establish, exercise, or defend legal claims.

We will identify the purposes for which we collect personal information at or before the time of collection, such as through this Privacy Policy, a form, or a verbal explanation at the point of collection.

6. Cookies and Similar Technologies

We use cookies, web beacons, and similar tracking technologies to operate our Sites, remember your preferences, understand how visitors use our Sites, and, where you consent, to support advertising and marketing analytics. The tools currently in use include Google Analytics and Cloudflare Web Analytics/Insights, as well as the Olark live chat service described in Section 4.

  • Strictly necessary cookies: required for a Site to function (e.g. keeping items in your cart, maintaining your session).
  • Performance and analytics cookies: help us understand how visitors use our Sites so we can improve them.
  • Functional cookies: remember choices you make to provide a more personalized experience.
  • Advertising/marketing cookies: used, where applicable, to deliver relevant advertising and measure its effectiveness.

Most browsers allow you to refuse or delete cookies through your browser settings. If you disable cookies, some parts of a Site may not function properly. Where required by applicable law, we will obtain your consent before placing non-essential cookies and will provide a mechanism for you to manage your cookie preferences.

7. How We Share Your Personal Information

We do not sell your personal information. We may share personal information with:

  • Other companies of The Gear Centre Group of Companies, and related companies under common ownership, for internal administration, shared IT and website hosting infrastructure, and to provide consistent customer service across our locations;
  • Service providers who perform services on our behalf, such as payment processing, website hosting, IT support, shipping and delivery, email and marketing platforms, analytics providers, and our live chat provider, who are contractually required to protect your information and use it only for the purposes we specify;
  • Professional advisors, such as our lawyers, accountants, auditors, and insurers, where necessary;
  • Manufacturers or suppliers of parts and equipment, where necessary to process warranty claims or special orders;
  • A purchaser or prospective purchaser in connection with a proposed or actual sale, merger, reorganization, or other transaction involving all or part of our business, subject to appropriate confidentiality protections;
  • Government authorities, regulators, or law enforcement, where required or permitted by law, including in response to a valid legal request, subpoena, or court order; and
  • Any other party, where you have provided your consent.

Some of our service providers may store or process personal information outside of Canada, including in the United States. Personal information stored outside of Canada may be accessible to courts, law enforcement, and national security authorities in that jurisdiction under its laws. We take steps to require our service providers to protect personal information to a standard comparable to the protections required under Canadian privacy law.

8. Your Consent

We will obtain your consent, express or implied, to collect, use, or disclose your personal information, except where permitted or required by law to do so without consent (for example, to comply with a legal obligation or in an emergency affecting health or safety). Consent may be implied by your conduct, such as when you voluntarily provide information to complete a transaction or request.

You may withdraw your consent at any time, subject to legal or contractual restrictions and reasonable notice, by contacting us using the information in Section 20 below. Withdrawing consent may limit our ability to provide certain products, services, or information to you.

9. Marketing Communications (CASL)

If you have consented to receive marketing or promotional communications (commercial electronic messages) from us, we will comply with Canada’s Anti-Spam Legislation (CASL), including by clearly identifying ourselves as the sender, providing our contact information, and including a functional unsubscribe mechanism in every message.

You may withdraw your consent and unsubscribe from marketing communications at any time by using the “unsubscribe” link included in our emails, or by contacting us directly. We will process unsubscribe requests within 10 business days, as required by CASL. Note that you may still receive non-promotional, transactional communications related to an existing order, appointment, or account.

10. Retention of Personal Information

We retain personal information only for as long as necessary to fulfill the purposes for which it was collected, including to satisfy legal, accounting, warranty, or reporting requirements. Retention periods vary depending on the type of information and the purpose of collection (for example, transaction and warranty records are typically retained longer than marketing preferences). When personal information is no longer needed, we securely destroy, erase, or anonymize it.

11. How We Protect Your Personal Information

We use physical, administrative, and technical safeguards appropriate to the sensitivity of the information to protect personal information against loss, theft, unauthorized access, disclosure, copying, use, or modification. These safeguards include restricting access to personal information to employees and service providers who need it to perform their duties, using secure networks and systems, and requiring contractual privacy and security commitments from our service providers.

No method of transmission or storage is completely secure. While we take reasonable steps to protect your personal information, we cannot guarantee its absolute security.

12. Accuracy of Your Personal Information

We will endeavor to keep personal information as accurate, complete, and up to date as necessary for the purposes for which it is used. You can help us by promptly notifying us of any changes to your contact or account information.

13. Your Privacy Rights and How to Exercise Them

Subject to applicable law and limited exceptions, you have the right to:

  • Access the personal information we hold about you and request information about how it has been used or disclosed;
  • Request that we correct or update inaccurate or incomplete personal information;
  • Withdraw your consent to our collection, use, or disclosure of your personal information, as described in Section 8; and
  • Ask questions or file a complaint about our privacy practices, as described in Sections 20 and 21.

To exercise any of these rights, please contact us using the information in Section 20. We may need to verify your identity before responding, and we will respond within the timelines required by applicable law. We may not be able to provide access in certain circumstances permitted by law (for example, where doing so would reveal personal information about another individual or is prohibited by law).

14. Automated Decision-Making

We do not currently use automated decision-making systems that make decisions about you based exclusively on automated processing, without human involvement. If this changes, we will update this Privacy Policy and provide any additional disclosure required by applicable law, including, for Quebec residents, information about the personal information used, the reasons for the decision, and the right to have the decision reviewed by a person.

15. Children’s Privacy

Our Sites are not directed to children, and we do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us using the information in Section 20 so that we can delete it.

16. Additional Information for Quebec Residents

If you are a resident of Quebec, the following additional provisions apply under Quebec’s Act respecting the protection of personal information in the private sector:

  • Our Privacy Officer, identified in Section 20, is responsible for ensuring compliance with this Privacy Policy and applicable privacy laws, and can be contacted with any questions or concerns regarding the protection of your personal information.
  • Where we transfer personal information outside Quebec (including to service providers located elsewhere in Canada or in the United States), we conduct an assessment to confirm the information will receive protection equivalent to that required under Quebec law before the transfer occurs.
  • If a confidentiality incident (privacy breach) involving your personal information creates a risk of serious injury, we will notify the Commission d’accès à l’information (CAI) and affected individuals, as required by law, and will maintain a register of such incidents.
  • You have the right to request that we cease disseminating your personal information, or de-index any hyperlink attached to your name that provides access to that information, where the dissemination contravenes the law or a court order and causes you serious injury, subject to the conditions set out in the Quebec Privacy Act.
  • You have the right, in certain circumstances, to receive personal information you have provided to us in a structured, commonly used technological format, and to have it transferred to another person or organization at your request (data portability).

17. Data Breaches

If we become aware of a breach of security safeguards involving personal information under our control that creates a real risk of significant harm to an individual, we will notify the Office of the Privacy Commissioner of Canada (and, where applicable, the relevant provincial regulator) and affected individuals, and will keep a record of the breach, in accordance with PIPEDA, PIPA, and, for Quebec residents, the Quebec Privacy Act.

18. Third-Party Links

Our Sites may contain links to third-party websites, including manufacturer, supplier, financing, or social media sites, as well as third-party product catalogue sites where we publish product information (for example, patsdriveline.com links to autoecat.com). We are not responsible for the privacy practices or content of third-party websites. We encourage you to review the privacy policy of any third-party website you visit.

19. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. We will post the revised Privacy Policy at gearcentregroup.com/privacy-policy with an updated “Last Updated” date. We encourage you to review this Privacy Policy periodically.
